we begin with breaking news out of the district, four people shot in northwest. around 9:15 tonight one female and three males we shot along the 1300 block of north capitol street, three victims taken to the hospital in serious condition, the fourth suffering

a graze wound. we have a crew on the way to the scene. also tonight a judge is ordering metro to allow controversial pro israeli ads to go up in its stations. thanks for joining us tonight. i'm brian bolter. >> i'm shawn yancy. those signs compare muslim radicals to savaging and sparked court battles in new york and d.c. fox 5's will thomas has the story. >> the d.c. court battle ended today when a federal judge ruled in favor of the group that wants to put up those controversial ads in metro stations. metro felt the ads could cause big problems like the anti- islam movie has done all over the middle east, but then there's that document called the constitution and first amendment. that won out today over safety concerns. four metro stations, glenmont, u street, takoma park, georgia avenue, these stations will see a pro israel ad go up next to

these others that equates muslim radicals with savages. here it is. it reads in any war between the civilized man and the savage support the civilized man. support israel. defeat jihad. metro didn't want to allow the posters up for a while, but a judge ruled friday the ads have to go up now. >> we live in a civilized society where free speech is protected. >> the attorney who won the case on behalf of the american freedom defense initiative, the group behind the poster, spoke with us via skype. metro said these are fighting words, you say protected speech. >> this is poor political speech which rests on the high s rung of first amendment protection. it can't -- highest rung of first amendment protection. it can't be silenced because a violent mob is intent on suppressing your speech. >> metro had concerns and showed the judge this video shot by a new york reporter of a woman defacing the posters

now hanging in subway stations. metro wanted to wait at least until november 1st to put up the ads at least until things calm down overseas. >> political speech is most effective when it's timely and these messages were exceedingly timely now and to delay them was government censure hip of speech. >> you just heard -- censureship of speech. >> you just heard from the lawyers. what about the riders that have to ride metro every day. we stopped by the glenmont station. >> i'm upset that the court would approve something like that. >> it's a worry, but we are blessed with freedom of speech. >> reporter: are you worried? >> no. >> reporter: why? >> because i'm not worried, nothing to be worried about. >> metro will comply with the court order which said the ads have to be up no later than 5:00 monday evening. one ad will appear in each of the four metro stations we mentioned for one month. these are stations requested by the group paying for the ads.

burglars have been kicking in the doors of howard county homes during the day stealing whatever they could. tonight police announced two arrests in the case. the suspects face charges in four burglaries and are suspected in as many as 10 others. fox 5's audrey barnes has the latest. >> you can still see i haven't repainted it yet. >> reporter: rebecca hudson was at work when she got a call that the side door of her ellicott city home had been jimmied and her home ransacked. >> it's a violation and it is a little scary, makes you a little uneasy. i'm really glad it happened during the day when he wasn't here. >> reporter: it's the second time she's been robbed in three years. she wasn't the only one in the neighbor hit this time. on the very next street the daylight burglars kicked in the door of another house looking for stuff to steal. the only thing taken during a robbery on is street in ellicott city was a pillowcase, some cash and two ravens tickets. those tickets turned out to be

the key that broke this case wide open. police showed up at ravens game september 27th and questioned the people who got in with those stolen tickets. as it turns out, one of them owns a memorabilia shop and had purchased them from a woman who came into his store. she left her name, diana market ii. >> really? they take nothing untraceable and then take those? >> reporter: 30-year-old marketti faces charges in four robberies. 40-year-old joseph baumgarten of pasadena, maryland, is also charged and they're being investigated in 10 other break- ins. >> it definitely taught me you need all your locks locked even in the nice neighborhood that i live in. you have to be careful and make sure that your house is secure. >> police say the burglars

stole more than those ticket -- sold more than those stolen ravens tickets. they were caught on surveillance video in pawn shops during the month of september. an amish man drowned in charles county, maryland. this is the view from sky fox of trinity lake. the man was reportedly fishing while his wife watched from the shore. she said somehow he fell out of the boat and was unable to swim. crews recovered his body two hours ago. authorities say he was not wearing a life vest. the september jobs report is out with promising news for the country. the unemployment rate fell below 8% for the first time in nearly four years. the labor department says the jobless rate fell to 7.8% and employers add 114,000 jobs. the numbers come as welcome news for president obama who campaigned in northern virginia today. fox 5's tom fitzgerald was with the president today and has the latest from the trail. >> reporter: for president obama it was a much needed shot in the arm.

>> this morning we found out that the unemployment rate has fallen to its lowest level since i took office. [ cheering and applause ] >> speaking at george mason university in fairfax the president held up the new 7.8% unemployment rate as proof that his policies are working. >> but today's news certainly is not an excuse to try to talk down the economy to score a few political points. nts. it's a reminder that this country has come too far to turn back now. >> reporter: >> but across the state in abington, virginia, mitt romney cast doubt on those numbers. >> the truth is if the same share of people were participating in the workforce today as on the day the president was elected, or unemployment rate would be around 11%. that's the real reality of what's happening out there. >> the president's fairfax speechad been aimed at his record on women's issues, a group i says has been helped by

new developments tonight in that deadly meningitis outbreak. the cdc says the number of cases has reached 47 and spread to a seventh state. five people have died including one in maryland and another in virginia. we have the latest. >> reporter: federal health officials investigating a deadly outbreak of meningitis. this outbreak is associated with a steroid that potentially is contaminated with a fungus. >> this really comes from steroid injections. we're not talking about steroids you take by mouth. liquid steroids that were injected mostly for back pain. they came from a central facility in new england. >> reporter: the steroid from a massachusetts specialty pharmacy sent to more than 70 clinics in over 20 states including california, texas and new york. the company is what is known as a compounding pharmacy. >> the general shortage of medications out there, these compounding centers have been

developed and what they do is mix the medication. they have stocks and almost produce them and they don't have the same standards as say a big pharmaceutical company does. >> reporter: the infected patients have shown a variety of symptoms including fever and headaches from one to four weeks after their injection. >> cdc is working with state and local health departments to contact patients who received the recalled lots of this medication to inform them they may have been exposed. it's possible we might identify more cases in the coming days. >> reporter: the fda urges physicians not to use any products at all that were manufactured at that massachusetts pharmacy. in new york julie banderas, fox news. a virginia woman claims her husband is a victim of the meningitis outbreak. sharon wingate says he received a steroid shot for back pain last month and later died of fungal meningitis. he received the shot at insight

imaging in roanoke. she believes it was contaminated and led to her husband' death. >> he was my soulmate. he was my best friend and to have a shot, six days later you're fighting for your life and you lose your life. >> wingate says she's frustrated no state or hospital officials have called her or answered her questions. she's consulting a lawyer. the medical examiner says autopsy results are pending and not available until next week. university of maryland is dealing with a bedbug problem that started in early september when students in the south campus common building 7 apartments complained of bites. the infestation has become a huge inconvenience at the worst time possible right during midterms. students have been forced to bag up their stuff for treatments on short notice. >> i would just like this process to be a little bit more considerate like towards us like it's really, really difficult. we're going through a lot of stress right now.

our living situation is horrible. i don't know. we can't live like this for six weeks. >> the next bedbug treatment is scheduled in two weeks. we're told the on campus apartment infected has private management separate from the university of maryland. for many this is the beginning of a long holiday weekend. a new law in the district will allow some bars to stay open up to 4 a.m. monday morning. not everyone thinks that's great idea. fox 5's matt ackland has details. >> reporter: the longer hours will only take place sunday night into monday morning. the bars approved on this list will be authorized to stay open until 4 a.m. it's something council member jim graham worries about. >> the key problem is there's no public transportation. so people who think that they want to go dripping until the later hour are -- drinking until the later hour are going to drive or they have to take a taxi. that's all they've got unless they live in the area. so i think that the congestion, the noise, the adverse

spillover effects is likely to increase, maybe not this weekend, but as the program expands. >> reporter: council member graham tried to kill legislation to keep bars open later. he didn't win that fight, but he scored a victory by trimming the late hours to only holiday weekends instead of all weekends. >> this first weekend out of a possible universe of 1,000, there are only 42 that have gotten permission. >> reporter: there have been some concerns about safety when it comes to those bars letting out an hour later, but chief lane-year-old says she doesn't see a -- chief lanier says she doesn't see a concern at all because there will be as many officers on the street at 3:00 in the morning as 4:00. matt ackland, fox 5 news. if you live or shop in montgomery county, you're no stranger to that five cent bag fee at stores countywide. no one lawmaker is asking if the tax applies to too many types of stores. earlier today at 5:00 we talked

to montgomery county council president who says he's not sure the fee should apply to retailers like dress shops and jewelry stores and wants to reassess the tax at the end of the year. >> in january it will have been a year. i've asked them to give us their views given that a number of other communities have gone forward with this program and see have we done this right? are we achieving our objectives? >> the council president says the county is on track to bring in $2 million this year from the back tax. he'd like that number to drop down to $1 million. the money goes toward environmental projects. coming up find out why a former redskins player wound up behind bars in vegas. >> plus rg3 talks about what it will take to beat the undefeated falcons. back in a minute. this is fox 5 news at 10:00. new information tonight in the july altercation outside a capitol hill 7-eleven that left david mercer with a serious head injury.

no charges will be filed. the case is now closed. fox 5's paul wagner has the story. >> reporter: last july 12th around 10 p.m. political consultant david mercer walked into this 7- eleven where he apparently got into a dispute with one of these men. law enforcement sources say mercer may have thought one of the men stole something from him and he reached into the man's pocket to retrieve it. as the men left the store, the dispute apparently got heated. this is what police had to say in the days after the incident. >> i can say at this point in time this is not a random assault. we do not believe this involved a robbery, but there was a dispute between the complainant and another individual and it turned physical at some point. >> reporter: when mercer left the 7-eleven, law enforcement sources say he was hit once in the face and fell backward hitting his head. the man who threw the punch claims he was defending himself. at mercer's capitol hill home today there was no answer. his next-door neighbor darrin howell says he hasn't seen the consultant since the attack, but hears his health is

improving. he was not happy to hear the case is closed. >> i'm definitely disappointed. i've known david for over a decade. he's a brilliant guy and to think that he's been permanently impaired because of this incident really just breaks my heart that there can't be any more action that would help lead more justice to take place. >> reporter: mercer's exact condition could not be learned. until he was injured in july mercer was a frequent guest on the cable network sharing his expertise on the political races. we were unable to reach david mercer or his family for reaction to the case being closed. one other note. some media outlets the days after the incident reported david mercer's phone was stolen and showed video that appeared to bolster that story. police say that never happened. in the fox 5 newsroom i'm paul wagner. more trouble for american

airlines, the airline hasnow -- excuse mem i'm going back. we are following -- me. i'm going back. we are following breaking news out of northwest did, five people shot along the 1300 block of north capitol street. audrey barnes with the latest. >> reporter: the call for shots fired here in the 1300 block of north capitol street came in at 9:11 tonight. i'll step away and let you see the scene behind me. police have the block cordoned off. we've seen a k-9 unit looking for evidence. we're told four males and one female were all found shot here at least once a little bit after 9:00 tonight. they've all been transmitted to the hospital. we're told they were conscious and breathing when they left the scene tonight. we are not at this point being led to believe this was a drive- by shooting. there is no lookout for a vehicle, but police say they do have a lookout for a suspect in

this case. he's described as a black male wearing a black t-shirt, jean shorts, white shoes seen leaving the scene after these five people were shot. neighbors are gathering on the street. they tell me there's been trouble on this block at least the last week. one woman reports a shooting about a week ago where three people were shot. so there has been trouble in the area. other people coming up and down the street have talked about some robberies, street crime, electronics and cash being stolen from people in this area. so tensions are high. all police are telling us right now is five people have been shot. they left the scene conscious and breathing and the investigation is just now getting underway. >> we'll see you with much more on the news edge at 11:00. back to that trouble for american airlines, the airline grounded dozens of nights as it tries to get a grip on those loose seat problems. american is pulling 48 of its 757s out of service for

repairs. several seats came loose midair on three different flights three different days. 50 flights were canceled thursday, 44 pulled today. fox's anna coyman has the latest. >> reporter: multiple midair scares prompting the quick fix, the airline making news last week while three different flights' seats popped loose. the seat lock plunger mechanism was the problem. if the locking pin doesn't reset, the seats can come loose. so american is adding an experimental faa approved device onto all the plunger mechanisms, more than 5,000 of them. >> working with our engineering and the faa. we quickly came up with an additional locking mechanism to add another level of riddance. >> reporter: american pulling 48 757s from service to make repairs on them. those planes only have two locking mechanisms instead of four like the rest of the fleet. the repairs causing temporary headaches for thousands of

passengers across the country, but the airline says the safety of its passengers and crew is their top priority. >> the additional redundancy we're building in will we think add another level of security and comfort. >> reporter: federal officials are continuing a safety investigation into the issue. american says all the planes should be back in service by saturday. in new york anna coyman, fox news. monitoring metro tonight and a new report finds the transit agency is not up to speed with measures to prevent visually impaired riders from falling onto the tracks. nearly 1/4 of metro's platforms do not have bumpy tiles along the edge of the platforms which help visually impaired riders navigate the stations. the plans to stall -- metro plans to stall nor tiles by 2015 but admits 11 more stations lack funding to add them. metro giving a sneak of its new 7 7000 series railcar,

a california boy scout has been kicked out and denied a top honor because of his

sexuality. 17-year-old ryan anderson says scout executives wouldn't sign off on his award because he didn't oblige his duty to gourd as part of the membership rules -- god as part of the membership rules. ryan's parents have started a petition and gathered more than 112 signatures. a boy scout spokesman says there are currently no plans to revisit their membership guidelines. the parents of a rutgers university student who killed himself after his roommate used a webcam to record him kissing another man have decided not to sue the university or anyone else involved in the case. tyler clementi's parents say they'll focus their efforts on the foundation in his name. his roommate was found guilty of biased intimidation and served 20 days behind bars. five teachers charged with indecent in discrimination engaging with sexual activities with three female students. the other employees are charged with trying to cover up the

acts. an assistant principal is accused with lying about one incident and helping another teacher cover up the alleged act. >> equally as disturbing and distressing as the charges against the teachers are is evidence that the principal and vice principal at tritan high school after learning of these improprieties failed to conduct them to the authorities and led a half hearted inquiry. >> all high of employees have been suspended. the superintendent says a comprehensive review has begun to prevent this from happening again. debating gay marriage on the gridiron, ahead on the news edge, two nfl members become very vocal. >> then stink bug invasion, a virginia man held hostage by hundreds of the creepy crawly insects.

me in my life that i wouldn't be able to do otherwise. >> reporter: that homebuyers workshop continues tomorrow all day from 8:00 to 5:00 at the d.c. convention center. on our website we have information about what you need to have before you go with you. in the newsroom i'm bob barnard. californians woke up to sticker shock today. gas prices jumped 20 cents a gallon in some areas overnight. aaa says the average cost for a gallon of unleaded in the state has risen to 4.49 a gallon. some stations ran out of gas and closed rather than pay the cost. analysts say the all time record which is 12 cents more than the current average could be shattered by this weekend. >> $10 in gas doesn't give me 1/4 of a tank. so it's really out of control. it's almost five bucks a gallon. >> i got gas yesterday at 4.69 and today i saw this at 5.69. i said no. >> analysts say refinery problems and pipeline outages

only 50, st. louis 54. we know now the nationals will be playing in st. louis sunday afternoon, should be partly cloudy with temperatures mid- 50s or so and a little breeze coming in 5 to 10 miles per hour. so cool in st. louis, but definitely it doesn't look like rain issues there. 58 degrees for wichita and then it's cooling down to the texas panhandle 65. ahead of the front temperatures today have been up to the 70s and 80s. definitely for sunday much cooler weather coming on. in here's the setup for the weekend. this trough of low pressure will be digging in pushing out the high that's kept us so warm the last few days. the coldest of the weather stays up into canada. it will be cool and cool all the way down to the deep south, cooling down for texas, too. probably the most significant cool air mass we've had in quite a while here and again with the clouds and chance of some showers on sunday we're thinking real chilly on sunday, again tomorrow not bad.
